General Terms and Conditions (Internet)
CTS Eventim Austria GmbH is not the operator of the events we offer. The organization of an event and the issuing of tickets are dealt with by the event's respective operator. As far as services associated with visiting the event are concerned, only the operator is liable, i.e. responsible to the ticket holder (customer). The resulting contractual relationship may be subject to the operator's own general terms and conditions. For events in Austria, CTS Eventim Austria GmbH is the ticket provider or the ticket agent. For events abroad, CTS Eventim Austria GmbH is the ticket agent, with the exception of individual cases where CTS Eventim Austria GmbH itself is explicitly identified as event operator. Regarding the ticket purchase, the customer enters a contractual relationship with CTS Eventim Austria GmbH.

I. Area of application
- Only the following terms and conditions apply in relation to CTS Eventim Austria GmbH for all contracts and orders placed regarding the supply of tickets, vouchers and/or fan merchandise (e.g. clothing, image and/or sound media).
- The general terms and conditions of travel apply for all contracts and orders placed regarding the arrangement or execution of trips, as well as the respective tour operator's general terms and conditions. These can be found in the references included in the respective offer.
- The use of personal data is regulated by the data privacy statement. The data privacy statement is an integral and binding part of the general terms and conditions at hand.
II. Conclusion of contract
- The offer of entering into a contract is made by the customer as soon as he clicks the "Buy now" button. The contract between the customer and the respective contract partner (operator, other salesperson, or CTS Eventim Austria GmbH) is only concluded when CTS Eventim Austria GmbH ("ticketing company") assigns and sends the customer a transaction number. Contrary to this, when advance payment is used as a mode of payment, the contract is concluded when CTS Eventim Austria GmbH mails a confirmation of receiving the complete payment.
III. Cancellation
- CTS Eventim Austria GmbH reserves the right to cancel a customer's order for which a transaction number has already been issued (unilateral right of cancellation) if the customer violates specific conditions set by the operator or by CTS Eventim Austria GmbH, to which reference was made in the context of advance sales, or if the customer attempts to circumvent these specific conditions (e.g. violation of the limited number of tickets per customer, violation of documentary conditions, especially violation of a ban on reselling, attempt to circumvent these conditions by means of registering and using several user profiles, etc.) Cancellation/withdrawal may also be declared by means of crediting the amounts paid. According to § 18 paragraph 1 line 10 FAGG, customers do not have a right of withdrawal.
- A right of withdrawal for consumers exists exclusively in accordance with paragraph X "Additional Terms for Fan Merchandise".
IV. Price components and methods of payment
- The prices for tickets may exceed the printed ticket prices. Depending on the event or product and/or purchased product and ordering method, payment is possible by credit card (Visa, Mastercard, American Express or Diners), prepayment, online banking, immediate bank transfer and by invoice or installment purchase. The legal value added tax is included in the price. The total price of the order including all fees is due for payment immediately after conclusion of the contract for the payment methods credit card, instant bank transfer and online banking. Notwithstanding the above, in the case of payment in advance, the total price must be transferred in full to the account specified by CTS Eventim Austria GmbH by the date notified. When purchasing on account with Klarna, the invoice amount is due for payment to Klarna Bank AB (publ) 30 calendar days after the purchase date. In the case of purchase by installment, the due date is determined according to the installment plan explained in the purchase process and communicated by Klarna by e-mail. The payment methods invoice or installment purchase do not exist for all offers and require, among other things, a successful credit assessment by Klarna Bank AB (publ). If the customer is allowed to purchase on account or in installments for certain offers after a credit check, the payment is processed in cooperation with Klarna, to whom CTS Eventim Austria GmbH assigns its payment claim. In this case, the customer can only pay Klarna with debt-discharging effect. In addition, the General Terms and Conditions of Klarna Bank AB (publ) shall apply to the payment methods invoice purchase and installment purchase. VISA and MasterCard payments are processed by the parent company CTS EVENTIM AG & Co. KGaA, Contrescarpe 75A, 28195 Bremen, Germany. Each ticket is only valid after full payment has been received.
- When ordering online, service and shipping costs are incurred and vary depending on the event and/or product. If the ticket price is up to € 10, no service fee shall be applicable. From a ticket price of € 10.01 a service fee of €1.50, from a ticket price of € 25.01 a service fee of €3.00 is already included in the total purchase price of a ticket that is displayed in the shopping cart; apart from the shipping costs and/or €1.50 international sales fee per ticket for events abroad, there are no further costs. For any additional services requested by the customer, such as gift wrappings or, where applicable, re-personalizations, the respective costs are displayed in the shopping cart and will be charged separately to the customer's account.
V. Right of withdrawal
When it comes to the following contracts, customers do not have a right of withdrawal, or their right of withdrawal may expire prematurely:
- Accommodation services for purposes other than living, transport of goods, renting of motor vehicles and supply of food and drinks, and services provided with relation to leisure activities, given a specific date or time frame is specified in the contract in order for the contract to be fulfilled (§ 18 paragraph 1 line 10 FAGG). That is to say if CTS Eventim Austria GmbH offers services in the area of leisure activities, especially tickets for events, there is no right of withdrawal. Any order of tickets is therefore binding as soon as CTS Eventim Austria GmbH has confirmed it according to II. 1. This confirmation obligates the customer to accept and pay for the tickets he/she has ordered.
- Audio and video recordings or computer software that arrived in a sealed package, if the seal has been removed after delivery (§ 18 paragraph 1 line 8 FAGG).
- A right of withdrawal for consumers exists exclusively in accordance with paragraph XIV "Additional Terms for Fan Merchandise".
VI. Due date for invoice payments
Invoice claims are due for payment on the calendar day specified in the invoice (payment target).
VII. Set-off
The customer only has a right of set-off if his/her counter-claims have been established in a legally binding way, or are undisputed or acknowledged by CTS Eventim Austria GmbH. Furthermore, the customer only has a right of set-off if and to the extent that his counter-claims are based on the same contractual relationship.
VIII. Shipping, use
Within Austria, tickets are sent by non-registered mail, unless the customer explicitly chooses a different shipping method. We advise you to be especially cautious when ordering Mobile Tickets in order to prevent data loss. Tickets must not be misused, copied or changed. When entering the venue, the principle of first entrance applies (the first ticketdirect or Mobile Ticket to be accepted by means of its non-ambiguous identification is the one that is valid. Later tickets with the same identification are automatically devalued when the first ticket is admitted). Before using the ticket, please familiarize yourself also with any applicable house rules of the venue.
IX. Digital access authorizations in the form of the OETICKET.Pass
- CTS EVENTIM Austria or OETICKET offers the purchase of admission authorization in the form of the OETICKET.Pass for selected events. This is a special form of use and management of admission authorization in digital form via an application (app) on a mobile device.
- An admission ticket in paper or other physical form will not be sent when purchasing an OETICKET.Pass. An OETICKET.Pass is deposited in the customer's oeticket account and, after retrieval by the customer, transferred to the oeticket app on the customer's mobile device on which the oeticket app is installed. From there, the customer can manage his OETICKET.Passes and use them for access to the respective event. For this purpose, the mobile end device must be carried along at the entrance and presented with the OETICKET.Pass upon request of the security personnel.
- The authorized ownership of the customer for the use of OETICKET.Passes can be verified at any time, for example, by TAN procedure. In case of corresponding system messages of the oeticket App, or e-mails requesting authentication, e.g. in the form of the TAN procedure, the customer must go through the authentication procedure in order to continue using his OETICKET.Passes. Otherwise, access to OETICKET.Passes may be blocked until proper completion of the verification process (which in the TAN procedure consists, for example, in entering the correct TAN).
- For the use of admission authorizations in the form of the OETICKET.Pass, the customer requires a compatible mobile device and must, if applicable, provide his cell phone number at the time of purchase (as well as, if applicable, other information, depending on the notes on the respective order page in the webshop or the oeticket app).
- If admission authorizations have been personalized and issued in the form of the OETICKET.Pass and the customer requests a re-personalization, a fee of € 10 (incl. VAT) shall be payable for each re-personalization of an admission authorization (re-personalization fee).

X. Additional Terms for Fan Merchandise (the paragraphs X, X a) and X b) apply exclusively to sales contracts for Fan Articles, e.g. clothing)
A sales contract with CTS Eventim Austria GmbH is only concluded when purchasing fan articles that are not purchased from another salesperson, but directly from CTS Eventim Austria GmbH.
CTS Eventim Austria GmbH reserves the right, not to accept contract offers, if the requested product is unavailable at the time of such offer. In this case CTS Eventim Austria GmbH will inform the customer and will not charge any payments or reimburse made payments.
Right to withdraw, specimen cancellation form
Consumers do not have a general right to withdraw, and any right of consumers to withdraw may lapse prematurely in the case of the following contracts:
- Services in the areas of accommodation other than residential purposes, transport of goods, rental of motor vehicles and delivery of food and drink and services provided in connection with leisure activities, provided that a specific time or period of time is contractually provided for the performance of the contract by the entrepreneur (§ 18 paragraph 1 line 10 FAGG). This means that if CTS Eventim Austria GmbH offers services in the area of leisure activities, in particular tickets for events, there is no right of withdrawal. Every order of admission tickets is therefore binding immediately after confirmation in accordance with Section II. 1. by CTS Eventim Austria GmbH and obliges you to accept and pay for the ordered tickets.
- Sound or video recordings or computer software that are delivered in a sealed package, provided that the seal was removed after delivery (§ 18 paragraph 1 line 8 FAGG).

Information on the right of withdrawal
Right to withdraw
You have the right to withdraw from this contract within fourteen days, without giving any reason.
The 14-days withdrawal period begins on the day on which the goods are received by you, or by a third person named by you, other than the carrier.
In order to exercise your right to withdraw, you must notify us,

of your decision to withdraw from the contract by sending us a clear written statement to that effect (e.g. in a postal letter, telefax message or E-Mail). You may use the specimen withdrawal form attached hereto, but are under no obligation to do so.
To keep within the withdrawal period, it is sufficient if you send your notification of exercising your right to withdraw before the withdrawal period ends.
Consequences of withdrawal
If you withdraw from this contract, we have to immediately refund to you any payments we have received from you, including delivery charges (except for the additional costs resulting from your choosing a different form of delivery than the standard, most favorable form offered by us), by no later than fourteen days after the day on which we receive notification of your withdrawal from this contract. To make the refund, we use the same means of payment as you used for the original transaction, unless explicitly agreed otherwise with you; you will not be charged anything for the refund. We may refuse to pay the refund until the goods have been returned to us or until you have provided proof that you sent the goods back, whichever is the earlier.
You must return or hand over the goods to us without delay, in any case no later than fourteen days after the day on which you notified us of your withdrawal from the contract. The goods shall be returned to the address which was disclosed before contract conclusion.
The latter deadline has been met if you dispatch the goods before the 14-days period has expired. The direct costs for returning the goods must be borne by you. You do not have to pay for any loss in the value of the goods unless such loss in value is due to your handling the goods in a manner other than is necessary to inspect the condition, properties and functioning of the goods.

End of information on the right to withdraw and specimen withdrawal form
The following shall apply in the event of withdrawal by the customer:
CTS Eventim Austria GmbH may refuse to pay the refund until the goods have been returned to CTS Eventim Austria GmbH or until the customer has furnished proof that the goods have been sent back, whichever is the earlier date.
The customer must return or hand over the goods to the address which was disclosed before contract conclusion without delay, in any case no later than fourteen days after the day on which the customer notified CTS Eventim Austria GmbH of his or her withdrawal from the contract. The latter deadline has been met if the customer dispatches the goods before the 14-day period has expired. The customer shall bear the direct costs for returning the goods. The customer must pay for any loss in the value of the goods if such loss in value is due to the goods being handled in a manner other than is necessary to inspect the condition, properties and functioning of the goods.
X a). Retention of title
For the sale of fan merchandise by CTS Eventim Austria GmbH as seller the following additional terms apply:
- If the customer is a consumer, CTS Eventim Austria GmbH shall retain legal ownership of the purchased item until the invoice amount has been paid in full.
- If the customer is a businessperson engaged in commercial or self-employed activity, or a legal entity under public law, or a public-law corporation, CTS Eventim Austria GmbH retains legal ownership of the purchased item until all outstanding debts in the business relationship with the customer have been settled.
X b). Warranty
For the sale of fan merchandise by CTS Eventim Austria GmbH as seller the following additional terms apply:
- In the case of fan articles (goods such as clothing or image and sound carriers), CTS Eventim Austria GmbH provides a warranty in accordance with the statutory provisions. For customers who are not consumers, CTS Eventim Austria GmbH is entitled to limit the warranty to the assignment of its own warranty claims against manufacturers or suppliers.
- Warranty for the suitability of fan articles for a specific purpose intended by the customer, which is not contractually agreed or objectively assumed, is not given. In the case of clothing items, there is also no warranty for any slight color deviations from the illustrations in the web shop that may occur, which are due to technical reasons, such do not constitute a defect. The receipt by CTS Eventim Austria GmbH or third parties of the fan articles returned by the customer as part of the assertion of warranty claims does not constitute an acknowledgment of a warranty claim.
The customer shall check fan articles for defects upon receipt. The check shall be carried out as it would have been possible for the customer in a retail shop. If the inspection goes beyond this and the fan item or its packaging is damaged as a result and/or the use of the fan item by the customer, or the value of the fan item is reduced due to other circumstances for which the customer alone is responsible, warranty rights are excluded in this respect. This also applies to shrink-wrapped and/or sealed data carriers (e.g. CDs, DVDs) if the seal or shrink-wrapping film has been removed by the customer.
XI. Cancellation of events, changes, refunds
For events in Austria, CTS Eventim Austria GmbH is the ticket provider or the ticket agent. For events abroad, CTS Eventim Austria GmbH is the ticket agent. In case of cancellation or if the event does not take place, CTS Eventim Austria GmbH is not liable for refunds, but will try to arrange them with the operator. Applicable service fees and shipping costs as well as re-personalization fees covering CTS Eventim Austria GmbH's expenditures shall not be refunded. For any ticket insurance (where applicable), the insurer's own general terms and conditions apply; to be found here.
The following applies if the operator instructs CTS EVENTIM AUSTRIA GmbH to refund and the respective amount is available to CTS Eventim Austria GmbH: the earliest date to return tickets is two Mondays after the date the cancellation of the event and the request for return has been announced. Mobile Ticket and ticketdirect users will receive the respective amount – if it has already been paid – only after the organizer has requested reimbursement in the same way they purchased their Mobile Ticket. The Mobile Ticket is automatically devaluated in the course of this process.
In the case of cancellation, postponement or any other change of an event, CTS Eventim Austria GmbH reserves the right to inform customers who purchased tickets for this event. Providing this information is a voluntary service of CTS Eventim Austria GmbH and may be received per mail and/or electronically per e-mail or text message, if the respective contact details are available to CTS Eventim Austria GmbH.
Cast and program are subject to change, as long as the changes are reasonable, minor and objectively justified. This also applies to changes in stage construction (plans), as long as they were initiated or required by the promoter or artists. In case of a cancellation, postponement or change, additional expenses (e.g. travel to the venue, hotel) will not be refunded.
XII. Vouchers
Vouchers can only be spent with the voucher partners listed on gutschein.oeticket.com and for the services specified. Please find a detailed description of the respective services on our website: gutschein.oeticket.com. Vouchers are valid for concrete services within 12 months ("validity period") after the date of issue (date the voucher was purchased), unless a different date is specified on the voucher. The validity period is defined by the date printed on the voucher. The terms and conditions of the voucher partner apply as well as the terms and conditions stated on this voucher. Contact the voucher partner to request their terms and conditions. If an appointment is bindingly agreed upon and the holder of the voucher fails to appear, the voucher expires without substitution. The voucher cannot be replaced in case of loss, theft or invalidation. The voucher cannot be returned or exchanged. Commercial resales are prohibited.
CTS Eventim Austria GmbH is only the provider for service vouchers and only the agent for value vouchers. In case of cancellation or if the event does not take place, CTS Eventim Austria GmbH is not liable for refunds. However, CTS Eventim Austria GmbH will seek to initiate refunds with the voucher partner. In case of cancellation, postponement or changes, expenses (e.g. travel expenses, hotel) will not be refunded.
XIII. Limitation of liability, exclusion of withdrawal in case of certain breaches of duty
- CTS Eventim Austria GmbH is unrestrictedly liable in all cases in accordance with the Product Liability Act for damages caused intentionally or through gross negligence, in the case of malicious concealment of defects, and for damages resulting from injury to life, health, and physical injury.
- In the case of a breach of significant contractual obligations (so-called cardinal obligations) that are only based on simple negligence, CTS Eventim Austria GmbH shall be liable limited to compensation for foreseeable losses typical for this type of contract.
- Apart from the cases stated in paragraphs 1 and 2, CTS Eventim Austria GmbH shall not be liable for losses caused by simple negligence.
- The customer's right to free himself/herself from the contract due to a breach of obligation for which the promoter or CTS Eventim Austria GmbH is not responsible and in which the goods are not damaged is ruled out.
- If the liability of CTS Eventim Austria GmbH is ruled out or limited under the paragraphs above, this also applies to the liability of their agents and assistants.
XIV. Final Clauses
The same general terms and conditions apply for the subsidiaries Ö-Ticket Nordost GmbH and Ö-Ticket Nord West GmbH, as well as for the license holders of CTS Eventim Austria GmbH sales software, as far as sales via the CTS Eventim Austria GmbH system are concerned. The general terms and conditions of CTS Eventim Austria GmbH's partner companies and subsidiaries abroad are available on their respective websites (see Eventim International). All disputes or claims arising from or in connection with these general terms are subject to Austrian law, excluding the rules of private international law and the UN Sales Convention. For consumers falling within the scope of Article 6 (2) of Regulation (EC) No. 593/2008 (Rome I), the foregoing choice of law shall apply only to the extent that it does not deprive them of the protection afforded by mandatory consumer protection provisions of the country in which they have their habitual residence. For business customers, the place of jurisdiction is the responsible court in Vienna. For private customers, the place of jurisdiction is the responsible local court.
